WASHINGTON, Ind. (WTWO/WAWV) – After an arrest was made Tuesday of a Washington man, Indiana State Police are trying to up the charge.
Tuesday, 26 year old Bobby Leighty was arrested for neglect causing serious bodily injury to one month old child Kyson Jones of Loogootee. Leighty was Jones’ caretaker.
Tuesday Jones was found unresponsive, Leighty called family members to help, who called 911. Jones was initially taken to the Daviess County Hospital before flown to Riley Children’s Hospital in Indianapolis via helicopter. Friday, Jones was taken off of life support today.
State police will now be presenting additional evidence to Martin County prosecutors to change Leighty’s charge from neglect resulting in serious bodily injury, a level 3 felony, to neglect resulting in death, a level 1 felony and any additional charges.
