TERRE HAUTE, Ind. (WTWO/WAWV) — A teen currently on probation in relation to the case surrounding the murder of Chloe Carrol has been arrested after police say they caught him stealing vapes from a Terre Haute gas station.
According to court documents, 18-year-old Cody Scherb was arrested in the early morning hours of March 29 after he led police on a foot chase in northern Terre Haute.
Police said they spotted two people near the entrance of the Express Mart located at 1831 N 3rd Street at 2:46 a.m. Wednesday, March 29. When the officer pulled into the parking lot the two people reportedly took off running down an alleyway behind the business.
A second officer responded to the area and located Scherb running down the alley. Scherb reportedly disregarded the flashing lights and demands to stop for some time as he continued running on foot. Eventually, an officer was able to cut off Scherb’s path and threatened to stun him if he didn’t comply, and Scherb was then placed under arrest.
Investigating police said surveillance video showed that Scherb and another person had used a rock to break through a glass area near the front entrance of the business. And that Scherb had been inside the business handing items through the broken glass to the other person outside.
Police said Scherb and the accomplice had attempted to steal six cartons of vapes and 18 individual vapes. The business estimated the total cost of the items was between $500 and $1,000.
The second suspect was never found.
In January, Scherb pleaded guilty to the charges of dangerous possession of a firearm and theft of a firearm. As a result, Scherb was sentenced to six years in prison but had that time suspended while being placed under formal probation for the same time period.
At the time of his sentencing, Vigo County Prosecutor Terry Modesitt said he hoped probation would allow Scherb to change his trajectory.
“Nonetheless, a maximum sentence of six years hanging over Mr. Scherb’s head gives him the chance to choose whether he changes his course of life and successfully completes this sentence or whether he continues down the same road, violates his probation, and faces going to prison,” Modesitt said.
Following his arrest Wednesday, Scherb was taken to the Vigo County Jail and booked on preliminary charges of burglary (a level 5 felony), resisting law enforcement (a class A misdemeanor), and possession of tobacco, an e-liquid, or electronic cigarette by a minor.
Publicly available court documents list that Scherb is being held on $35,000 bond with no 10% allowed. He is set to appear in court on April 3 at 1:30 p.m. for an initial hearing related to this arrest.
